The Department of Law/Office of the Attorney General, Civil Litigation and Employment Law Section is seeking an attorney with expertise in wage and hour law for a position in our Employment Practices and Civil Rights Unit. The Senior Specialist Assistant Attorney General – Fair Labor Standards Act position offers an exciting opportunity to work with various state agencies and institutions of higher education on unique wage and hour issues and to form lasting and rewarding client relationships in a position with frequent client interaction. The attorney will serve as an advisor and litigator, will be the subject matter expert on wage and hour and other employment work, and will perform some labor work, based on unit and client needs. We are looking for a person who excels at independently tackling new issues on a regular basis and who is eager to engage as a part of the Employment Practices team.
WHAT YOU WILL DO
In this role, you will have the opportunity to:
- Serve as subject matter expert, providing advice to state agencies and institutions of higher education with regard to compliance with the Fair Labor Standards Act (FLSA), State Personnel Board Rules and Director’s Procedures concerning wage and hour matters, and other employment matters that may arise. You will guide clients through assessing how the federal law intersects with Colorado’s state personnel system and collective bargaining agreements under the Colorado Partnership for Quality Jobs and Service Act, and you will help draft policies to capture the nuances of these intersections. You will assist clients in resolving wage and hour and other employment disputes prior to litigation, including negotiating, drafting, and implementing settlement agreements.
- Provide training about wage and hour matters to client agencies and institutions.
- Represent agencies and institutions of higher education in wage and hour disputes in state or federal court and in related appellate matters.
- Represent agencies and institutions of higher education in wage and hour disputes in front of the U.S. Department of Labor Wage and Hour Division and other administrative investigatory bodies.
- Represent agencies and institutions of higher education in employment matters before the State Personnel Board in all phases of administrative hearing and post-hearing litigation, and occasionally in state and federal court. These duties will include trying cases before an administrative law judge, filing and arguing appeals before the Board, the Colorado Court of Appeals and the Supreme Court, and occasionally trying cases before a judge or jury in state or federal court.
This recruitment may be used to fill more than one Assistant Attorney General position from this recruitment.
Salary note: Although a salary range is listed, salary will be set commensurate with the successful candidate’s qualifications and in compliance with the Equal Pay for Equal Work Act.
WHAT WE ARE LOOKING FOR
For this Senior Specialist attorney position, we are seeking applicants who have:
- A minimum of five years of demonstrated experience with FLSA litigation and wage and hour advice work with clients. Experience in the government sector and/or in a collective bargaining environment will be particularly helpful.Applicants should highlight in their cover letter any experience with negotiating, drafting, and implementing settlements of wage and hour matters; drafting wage and hour policy; and providing training to clients. Applicants are also encouraged to describe their experience with hours worked issues and other issues related to the Fair Labor Standards Act, U.S. Department of Labor regulations and other guidance.
- Applicants must be admitted to the Colorado bar or be clearly eligible to waive into the Colorado Bar and be in good standing at the time of application. Candidates eligible to waive into the Colorado Bar will be required to submit proof of their completed application before the first day of employment.
In order to be effective in this role, you must also have:

In order to be appointed as a Senior Specialist Assistant Attorney General, candidates must demonstrate a minimum of five years of experience with wage and hour law. If the position isn’t filled at the level of Senior Specialist Assistant Attorney General, the pay range will be that of Assistant Attorney General II, which is $7,100-$9,000/month, commensurate with the successful candidate’s qualifications.

Conditions of Employment:
- Applicants must pass a thorough background investigation prior to appointment.
- Effective August 15, 2022, this position will require documented proof of full COVID-19 vaccination.
