Statement from Attorney General Phil Weiser on the U.S. Supreme Court dismissing emergency abortion care case

June 27, 2024 (DENVER)—Attorney General Phil Weiser released the following statement regarding today’s U.S. Supreme Court decision to dismiss a case regarding emergency abortion health care in hospitals:

“Emergency care under federal law has always included abortion care necessary to save a woman’s life or health, and it will remain so for now. With the Supreme Court dismissing this case today, emergency department doctors will be able to provide emergency abortion care to save women’s lives.

“Emergency abortion care is healthcare, and this ruling protects the lives and well-being of those facing life-threatening conditions during pregnancy. Medical decisions should be made by women and their doctors, and doctors must have the assurance that they can provide necessary emergency care without fear of criminal prosecution.

“But today is not a day to celebrate. The court merely kicked the can down the road, and a similar case, as well as other extreme abortion measures, will be back at the court. Women will continue to seek abortion care in safe states like Colorado where it is still legal. The attacks on reproductive rights and abortion care will not stop. I will continue to fight any attempt to rollback patient safety and reproductive freedom.”

Colorado was part of a coalition of state attorneys general that filed a court brief defending emergency abortion care in the case Moyle v. United States.
