Statement from Attorney General Phil Weiser on the U.S. Supreme Court refusing to limit access to abortion drug

June 13, 2024 (DENVER)—Attorney General Phil Weiser released the following statement regarding today’s U.S. Supreme Court ruling rejecting a lawsuit to restrict access to the abortion pill mifepristone:

“I am pleased with the U.S. Supreme Court’s unanimous decision to reject the lawsuit challenging the FDA’s regulation of the abortion pill mifepristone. The court ruled that the forces attempting to restrict access to medication abortion did not have a legal right to sue because they were not directly affected by the FDA’s regulation of mifepristone. This means that mifepristone remains available across the country, for now. Protecting access to medication abortion is crucial for upholding equality, bodily autonomy, and the well-being of those seeking reproductive healthcare.

“Mifepristone is supported by robust evidence and clinical research demonstrating its safety and effectiveness. Imposing medically unnecessary restrictions on this medication endangers reproductive health outcomes, particularly for low-income and underserved communities.

“While this ruling is a positive step, we must remain vigilant in protecting Coloradans’ right to reproductive freedom. In the wake of the 2022 Dobbs decision overturning Roe v. Wade, we continue to face significant challenges, and I remain committed to fighting for reproductive and abortion healthcare.”

Colorado was part of a coalition of states filing a court brief defending access to mifepristone in the case Food and Drug Administration v. Alliance for Hippocratic Medicine.
