Attorney General Phil Weiser wins court order blocking unlawful SNAP food benefit pilot project in Colorado
Jan. 28, 2026 (DENVER) – Attorney General Phil Weiser issued the following statement after a federal court issued a preliminary injunction blocking the U.S. Department of Agriculture and Secretary Brooke Rollins from requiring Colorado to comply with a so-called pilot program as a condition of SNAP food benefits for those in need:
“I am pleased that the court blocked the USDA from forcing Colorado to participate in a pilot program to recertify within 30 days over 100,000 households that receive SNAP food assistance in the state. Colorado did not receive advance warning or time to prepare, the timeline would have been impossible to meet, and the state faced removal from the SNAP program if it did not comply.
“This was not a real pilot project. It was punishment from the Trump administration and Agriculture Secretary Rollins who disagree with our mail in ballot elections and how we carry out our state criminal justice system. The administration cannot punish Coloradans into submission, and I’ll continue to fight back when the federal government harms Colorado and acts like it’s above the law.”
The SNAP food benefits pilot project claims are part of an updated lawsuit Weiser filed earlier this month challenging the decision to move Space Command HQ to Alabama and several other actions the Trump administration has taken as part of a revenge campaign against Colorado.
