Attorney General Phil Weiser statement on the U.S. Supreme Court opinion striking down Trump’s attempt to end birthright citizenship
June 30, 2026 (DENVER) – Attorney General Phil Weiser released the following statement regarding today’s Supreme Court decision in the birthright citizenship case:
“Today, the Supreme Court reaffirmed the long-standing right to citizenship enshrined in the Constitution: If you are born in this country, you are a U.S. citizen. The president issued his birthright citizenship executive order with blatant disregard for the Constitution. It’s astonishing that we had to fight this case because the Citizenship Clause of the 14th Amendment is so plainly clear.
“The president cannot rewrite the Constitution or redefine what it means to be American with the stroke of a Sharpie. Democratic state attorneys general stand united as a bulwark against the Trump administration’s lawless power grabs and actions, and we will continue fighting for our rights and the rule of law.”
On his first day in office in 2025, President Trump issued an executive order to end birthright citizenship for countless children born in the United States to immigrant parents, in violation of the Fourteenth Amendment of the U.S. Constitution and Section 1401 of the Immigration and Nationality Act.
Attorney General Weiser and a group of states immediately filed a lawsuit challenging the order in a Boston federal court. The suit was successful, repeatedly obtaining nationwide preliminary injunctions that blocked this executive order from ever taking effect.
The attorney general joined with a multistate coalition in filing a brief defending birthright citizenship in the case before the court, Donald J. Trump v. Barbara (PDF).
